It Is The Democrats That Have Committed Impeachable Offenses

 In a post on July 25 of this year, I questioned the judgment of Democrats based on their efforts to uncover evidence for impeachment of President Trump by having Robert Mueller testify in an open hearing in Congress. What I stated implicitly or explicitly is that the actions of the Democrats were so driven by hate that they have become deranged and delusional. I also stated in that post that Democrats have no shame and no honor when it comes to building a case for impeachment against Trump.

Proving what I said is true, is this anonymous whistleblower complaint that came to light several days ago alleging that Trump pressured the newly elected President of Ukraine, Volodymyr Zelensky, to open an investigation into presidential candidate Joe Biden and his son Hunter Biden by withholding military aid from Ukraine during a phone call on July 25th of this year. An important fact to keep in mind is that the anonymous whistleblower had no direct knowledge of what was said during the phone call in question. Yet, Democrats, led by Speaker of the House Nancy Pelosi, opened a formal impeachment inquiry Tuesday (9/24/19) into the President, even though, they too had no knowledge of what was said in the phone call Trump had with the Ukranian president. This is  more evidence that Democrats are willing to do anything in order to impeach President Trump, even on uncorroborated allegations in an anonymous complaint. The President said in a tweet Tuesday (9/24/19) that he would release a full unredacted transcript of the phone call at the heart of this matter, and stated he was open to releasing the entire whistleblower's complaint. Yet, the Democrats, who don't really care about facts when it comes to impeaching Trump, exhibited no discipline or self-control by waiting for the facts to come out when they opened their formal impeachment inquiry.

The Democrats have a history of either destroying or attempting to destroy political opponents or those who they oppose based on uncorroborated allegations of misconduct that often times occurred decades ago. The most notable cases involve Justice Brett Kavanaugh and Judge Roy Moore. Who can forget: "I believe her." This is totally inconsistent with the values we claim to have in our republic where a person is considered innocent until proven guilty. Now they have come out in favor of this impeachment inquiry based on the fraudulent and insincere claim they are protecting our democracy. Speaker Pelosi said that it's not a good thing for democracy. Congressman John Lewis said the future of our democracy is at stake. The comments by Speaker Pelosi and Congressman Lewis are pretty much the sentiments of the overwhelming majority of Democrats. What a bunch of liars and hypocrites they are. We lost our democracy a long time ago because of public corruption.

Perhaps the most profound claim that many Democrats are using to justify an impeachment proceeding is that President Trump should be held accountable because "no one is above the law." REALLY? They make this ridiculous claim after encouraging, enticing: let's be honest, begging undocumented immigrants to break federal law by entering our country illegally at the southern border. Once these immigrants enter the country, many democratically run cities flout federal immigration law by providing sanctuary for them, even in cases where they have violated other laws once on American soil. To further show their utter contempt for our nation's sovereignty, they want to provide free health care to all undocumented immigrants and provide them many other benefits that are normally reserved for lawful residents. The only time it seems that they support the rule of law is when it comes to the conduct of President Trump.

Wednesday morning (9/25/19) President Trump released the transcript of the phone call he had with the Ukranian president. There is no evidence of a quid pro quo between President Trump and President Zelensky; even though the two discuss a potential investigation by Ukraine into Joe Biden and his son Hunter Biden. I read the entire transcript and I am speechless that the Democrats would want to impeach Trump over what was said in the phone call. How could any reasonable and rational human being say that this was a shake down by the President? Well, House Intelligence Chairman Adam Schiff did. How can can any rational human being say that Trump was pressuring the Ukranian president to investigate the Bidens or anyone else. The Democrats are. Maybe the words "can you do me a favor" and "if it's possible" have taken on a different meaning.  Later in the day on Wednesday (9/25/19), the whistleblower complaint was released. As to be expected most Republicans and Trump supporters believe that Trump did not do anything wrong; whereas, most Democrats and Trump haters believed he committed some impeachable crimes. What this means for Americans is that the impeachment inquiry by Democrats will continue indefinitely. To that end, the Director of National Intelligence was called to testify today (9/26/19) before the House Intelligence Committee headed by Democrat Adam Schiff. Folks please don't be fooled. All this impeachment nonsense is about politics and the Democrats weaponizing their constitutional authority to provide oversight of the President who is the head of the Executive Branch of government.

What is occurring is a disgrace. Like I said earlier, I read the entire transcript of the phone call in question. I can not say whether or not Trump had in the back of his mind that Joe Biden's campaign would be harmed by an investigation into his son's business dealings. However, when there is a question as to what someone said and their intentions, you look at the actual words that were uttered. And looking at the words of President Trump and President Zelensky the reasonable conclusion is that they were talking about rooting out corruption. Nevertheless, Trump should accept some of the blame for this spectacle. As is always the case with politics, appearance is everything. Trump has every right to have the actions of Joe Biden investigated based on Biden's own admission that there was a quid pro quo arrangement between the US and Ukraine over millions of dollars in aid. There is a legitimate question whether or not Biden's son Hunter benefited financially from the elder Biden's quid pro quo. Certainly, no reasonable person is going to suggest that being a presidential candidate is some type of immunity or shield from a corruption investigation. Don't Democrats and their supporters in the media remember that the Trump campaign was investigated after he had already secured the Republican nomination? Much of the information, albeit it false, used to initiate that investigation ironically came from the Ukraine. The Joe Biden campaign should not be treated any different from the Trump campaign. However, knowing that everything he says will be hyper scrutinized, and knowing that any number of people are willing to leak the content of his confidential conversations, and knowing that the Democrats are willing to characterize anything he says and does as misconduct, Trump should accept the clear fact that he is partly to blame for his predicament. This was a temporary lapse in judgment by bringing up the Bidens in a conversation about an investigation, knowing that his haters would perceive this as election meddling. But it is clearly, without any thing else, not a situation that calls for impeachment. The Democrats know that very well, and I'm sure they will keep looking.

For me, this is about more than an impeachment inquiry. I am troubled by the way this whistleblower complaint is being treated compared to the way several public corruption complaints I  filed against San Jose city officials, officials with the US District Court, and the Ninth Circuit Court of Appeals have been handled by several government officials in Washington, DC, including Speaker of the House Nancy Pelosi, House Intelligence Committee Chairman Adam Schiff, and House Judiciary Committee Chairman Jerrold Nadler. I mention these three by name at this point because they are the ones spearheading the impeachment inquiry against the President.

My public corruption complaints allege that my former attorney (Stuart Kirchick), San Jose Mayor Sam Liccardo, the San Jose City Council, San Jose City Attorney Richard Doyle and several attorneys with the City of San Jose, and three retired San Jose police administrators (Chief of Police Rob Davis, Assistant Chief of Police Tuck Younis, and Deputy Chief of Police Adonna Amoroso) conspired with the US District Court in San Jose, and the Ninth Circuit Court of Appeals to hide racist and bigoted actions taken against me by the above named San Jose city officials, during the litigation of two discrimination lawsuits I filed against the City of San Jose . In my complaints, I allege that the above officials committed several felonies that include fraud (creating false documents and conducting a fake court proceeding on a motion I filed), subornation of perjury and perjury, bribery, conspiracy to obstruct justice and obstruction of justice, and witness tampering. I also alleged that the decisions in my lawsuits by the US District Court and the Ninth Circuit Court of Appeals were flagrantly biased and totally inconsistent with the facts and well established precedent and statutory laws. Additionally, I alleged that the San Jose Police Department investigated me for criminal misconduct or a security risk based on two non-threatening emails I sent to Mayor Liccardo and San Jose City Council Members.This was done to intimidate me and to have a chilling effect on my freedom of speech.

How does this relate to the whistleblower complaint that's at the center of this impeachment inquiry? It is how Speaker Pelosi, Chairman Nadler, and Chairman Schiff have reacted to the whistleblower complaint compared to public corruption complaints I made with them against the San Jose city officials and the federal court officials mentioned above. The impeachment inquiry was started by Democrats based on their dubious claims that they take their oaths of office seriously; and that they have a constitutional obligation to hold President Trump accountable for his abuse of power. As stated already they say that no one is above the law, not even the President. I have already proved that this is a lie by pointing out that they have literally begged undocumented immigrants to break federal law and come into this country illegally. My biggest concern is the treatment of the whistleblower complaint by Speaker Pelosi, Chairman Schiff, and Chairman Nadler compared to how they have treated my complaint. The whistleblower complaint and my complaint both alleges, potential criminal activity, an abuse of power, a quid pro quo, national security implications because the misconduct alleged poses a threat to our democracy, and a cover up. However, there is a huge difference between my complaint and the anonymous whistle blower complaint. My complaint is not anonymous. I provide my name and make myself available for contact in order to provide additional information. I have firsthand information regarding my allegations. In fact, I am the victim of the alleged misconduct that was based on my race and disability. I am black/African American. My complaints states specific crimes that were committed. I provided incontrovertible evidence with my complaints in order to corroborate the crimes I allege. The whistleblower's complaint does not state specific crimes allegedly committed by the President, and did not have corroborating evidence for any of the claims listed. I suffered a significant financial loss and experienced extreme emotional distress that was inflicted intentionally by the accused officials. It is unknown if the whistleblower suffered any damages.

It is not my intent to suggest that the whistleblower's complaint didn't deserve the special treatment it received. However, when compared to the transcript of the call between President Trump and President Zelensky, the allegations in the complaint seems overblown and exaggerated. When comparing the allegations in my complaint to the evidence I submitted to corroborate them, the allegations in my complaints are understated. Yet, Speaker Pelosi, Chairman Schiff, and Chairman Nadler were aggressive in their push for an impeachment inquiry even before receiving the transcript or the complaint. As for my complaint, I have not received a response from Speaker Pelosi, Chairman Nadler or Chairman Schiff; even though, they document an abuse of power far more reprehensible than what has been established by the anonymous whistleblower's complaint and the transcript of the call between President Trump and President Zelensky. What the Democrats are asking Americans to do in regards to the whistleblower's complaint and the transcript of the phone call is to believe what they say and not what you read. They want you to believe that the transcript is proof that there was pressure put on the Ukranian President by President Trump to investigate the Bidens in order to corruptly influence the 2020 elections. The  transcript simply does not support that claim. More importantly, President Zelensky states unequivocally that he was not pressured on that call. However, I have an open mind and I am willing to listen to any other evidence that might prove President Trump committed impeachable offenses.

Both Speaker Pelosi and Chairman Schiff have stated in interviews today that the White House is engaged in a cover up, and that Director of National Intelligence Joseph Maguire committed a crime by not immediately transferring the whistleblower's complaint to Congress. Yet, it is they who have committed a crime and betrayed their oath of office by covering up an abuse of power scandal involving several San Jose city officials, the US District Court in San Jose, and the Ninth Circuit Court of Appeals. The evidence is incontrovertible that these two courts engage in case-fixing; and that many cases, primarily pro se, are disposed of by court personnel other than judges with summary dispositions that are not in line with the precedent of the Supreme Court or the Ninth Circuit Court of Appeals. It is Speaker Pelosi, Chairman Schiff, Chairman Nadler, along with several other officials, Republican and Democrat, elected and appointed that have committed impeachable offenses far more egregious than any potential misconduct by President Trump in his phone call with President Zelensky of Ukraine. Re: Ethics Violations by Members of the House of Representatives

Dear Members of the Office of Congressional Ethics:

            I respectfully request that your office conduct an investigation into ethics violations and criminal misconduct by the following Members of the House of Representatives and/or their staffs: Speaker of the House Nancy Pelosi, Chairman of the House Judiciary Committee Jerrold Nadler, and Chairman of the House Intelligence Committee Adam Schiff. I am alleging that Speaker Pelosi, Chairman Nadler, Chairman Schiff, and/or members of their staffs are engaged in a cover-up of racism and criminal misconduct by San Jose city officials, officials with the U.S. District Court for the Northern District of California – San Jose Division and the Ninth Circuit Court of Appeals that occurred during litigation of two lawsuits I filed against the City of San Jose for racial and disability discrimination. I am black/African American. Speaker Pelosi, Chairman Nadler, and Chairman Schiff failed to take action on letters I submitted to each detailing the racist and criminal acts perpetrated by San Jose city officials and officials with the U.S. District Court and Ninth Circuit Court of Appeals. The criminal misconduct by San Jose city officials and the courts include bribery, conspiracy to obstruct justice and obstruction of justice, subornation of perjury and perjury, fraud, and witness tampering. These criminal acts involve creating a false document relative to a fraudulent stipulation of dismissal, falsifying court records, staging a phony hearing on a motion I filed and creating a fraudulent transcript and civil minutes for that hearing that contradict each other. Furthermore, the rulings of the courts in each of my lawsuits are biased in favor of the City of San Jose and they are wholly inconsistent with the indisputable facts and well established law.
            On the website of the Office of Congressional Ethics, it states that the Office of Congressional Ethics of the House of Representatives is an independent, non-partisan entity charged with reviewing allegations of misconduct against Members, officers, and staff. It is sufficiently clear that this matter is within the jurisdiction of the Office of Congressional Ethics. It is also well established that the First Amendment of the U.S. Constitution guarantees the right of the people to petition the government for a redress of grievances. The definition of redress by Merriam-Webster is to set right or remedy an unjust or unfair situation.
            It is important to note that there are no pending actions in court relative to my two lawsuits because the courts have entered their final judgments. Nothing precludes Congress from conducting investigations into my allegations against the courts based on Congress’ constitutional authority/obligation to provide oversight. It is important to keep in mind that my allegations against the courts and the City of San Jose involve very serious criminal

misconduct. In order to support my allegations of criminal misconduct by San Jose city officials and the courts are two attachments in pdf format on a flash drive that’s included in this packet. One attachment contain copies of a letter and documents sent to Inspector General Michael Horowitz alleging that former Attorney General Jeff Sessions and F.B.I. Director Christopher Wray, along with several other officials in the Department of Justice and F.B.I. are engaged in a cover-up of the criminal misconduct of San Jose city officials and federal court officials. The other attachment contains copies of a letter and documents I sent to Chief Judge Sidney R. Thomas of the Ninth Circuit Court of Appeals that is undeniable proof that the judgments in my two lawsuits against the City of San Jose are based on fraud; and that they are in violation of the Constitution and well established precedent and statutory law. The judgments are by law null and void. Yet, the courts refuse to vacate them. Also on the flash drive are copies of the complaint letters I sent to Speaker Pelosi, Chairman Nadler, and Chairman Schiff; along with copies of complaint letters I sent to Senator Lindsey Graham, Senator Dianne Feinstein, Senator Chuck Grassley, Senator Kamala Harris, Attorney General William Barr, Chief Justice John Roberts, and Ninth Circuit Court of Appeals Chief Judge Sidney R. Thomas.
The conduct of San Jose city officials and federal court officials is an egregious abuse of power that violates the public trust. What makes their conduct truly appalling is that their intent is to cover up racism, bigotry and corruption. The evidence of racism by San Jose city officials is indisputable because they state in court papers that the City’s anti-discrimination policies does not protect me, a black person, and that they had no duty to investigate my racial discrimination complaints against City officials. Even though San Jose city policy specifically states that discrimination complaints will be investigated, the courts ruled in favor of the City stating that there were no set of facts that I could allege to make my racial discrimination claim viable. It is worthy to note that state law and precedent also establish that City officials had a duty to investigate my discrimination complaints, and that they can be held liable individually under Section 1983 based on their deliberate indifference. Further evidence of bias by the courts and indifference to the City’s racist conduct is that the court in one proceeding exhibited hostility toward my discrimination lawsuit by asking why I was making this a federal case and why I didn’t just drop the darn thing (my lawsuit). Bias is also indicated by the fact that the courts ruled in favor of the City in my first lawsuit despite City officials’ admission that they had violated City policy and a state law that implicates a constitutionally protected interest. This flagrant bias against me by the courts also makes the judgments in my lawsuits null and void. 
In covering up this clear case of bigotry and public corruption, Speaker Pelosi, Chairman Nadler, and Chairman Schiff have violated the ethics rules of the House of Representatives, as well as the oath they took to protect and uphold the Constitution. A credible criminal case for collusion and obstruction of justice can also be made against Speaker Pelosi, Chairman Nadler, and Chairman Schiff because the intentional cover-up of a crime is in itself a crime. An investigation into this matter is warranted in order to protect the integrity of our judicial system and to set right this unjust situation. Please inform me of what action the Office of Congressional Ethics will take in regards to my complaint.
