Pending Ethics Complaints Against Pelosi, Nadler, and Schiff Undermines the Impeachment Inquiry

As Democrats move forward with a formal impeachment inquiry into the conduct of President Trump with public hearings, their leaders, Nancy Pelosi, Adam Schiff, and Jerrold Nadler face their own ethics complaints with the Office of Congressional Ethics. The ethics complaints which were filed by me on August 12th allege that the three Democrats violated the ethics rules of the House of Representatives, as well as, their oaths to protect and uphold the Constitution. The ethics violations against Pelosi, Nadler, and Schiff are based on their intentional cover-up of racist and criminal misconduct by San Jose city officials, officials with the U.S. District Court and the Ninth Circuit Court of Appeals that occurred during litigation of two lawsuits I filed against the City of San Jose for racial and disability discrimination. I am black/African American. Pelosi, Nadler, and Schiff failed to respond to complaint letters I filed with them in 2018 and earlier this year that details a case-fixing scheme by San Jose city officials and federal court officials involving perjury, bribery, fraud and several other public corruption crimes.

 The ethics complaints against Pelosi, Nadler, and Schiff undermine impeachment proceedings against President Trump, making the proceeding appear partisan and politically motivated. Democrats have accused the president of abusing his power, violating the Constitution, and betraying his oath of office based on his phone call with President Zelensky of Ukraine. Pelosi and the Democrats have stated constantly that they have a constitutional responsibility to provide oversight of Trump and to hold him accountable. Pelosi has stated that the first responsibility of Congress is to protect the Constitution. She also stated that the purpose of the impeachment inquiry is to build an “ironclad” case for impeaching the President. These claims by Pelosi are disingenuous considering that she, Nadler and Schiff have refused to open an inquiry into the ironclad case of racism and criminal misconduct by San Jose city officials and officials with the U.S. District Court and the Ninth Circuit Court of Appeals. The impeachment inquiry reveals a double standard by Pelosi, Nadler, and Schiff. While zealous in their oversight of the President based on accusations that he has violated the Constitution, they have deliberately covered up several violations of the Constitution by the Ninth Circuit Court of Appeals and the U.S. District Court during litigation of my lawsuits against the City of San Jose. Pelosi, Nadler, and Schiff have made a conscious decision to ignore their constitutional responsibility to provide oversight of the federal courts with the same resolve as President Trump. For this reason, it should be difficult for Americans to view the impeachment inquiry as having any credibility. It is Pelosi, Nadler, and Schiff that are guilty of committing impeachable offenses by their cover-up of the criminal, racist and bigoted misconduct of San Jose city officials and officials with the US District Court and the Ninth Circuit Court of Appeals. Below are copies of my complaint with the Office of Congressional Ethics and the notices I sent to Pelosi, Nadler, and Schiff:

Re: Ethics Violations by Members of the House of Representatives

Dear Members of the Office of Congressional Ethics:

            I respectfully request that your office conduct an investigation into ethics violations and criminal misconduct by the following Members of the House of Representatives and/or their staffs: Speaker of the House Nancy Pelosi, Chairman of the House Judiciary Committee Jerrold Nadler, and Chairman of the House Intelligence Committee Adam Schiff. I am alleging that Speaker Pelosi, Chairman Nadler, Chairman Schiff, and/or members of their staffs are engaged in a cover-up of racism and criminal misconduct by San Jose city officials, officials with the U.S. District Court for the Northern District of California – San Jose Division and the Ninth Circuit Court of Appeals that occurred during litigation of two lawsuits I filed against the City of San Jose for racial and disability discrimination. I am black/African American. Speaker Pelosi, Chairman Nadler, and Chairman Schiff failed to take action on letters I submitted to each detailing the racist and criminal acts perpetrated by San Jose city officials and officials with the U.S. District Court and Ninth Circuit Court of Appeals. The criminal misconduct by San Jose city officials and the courts include bribery, conspiracy to obstruct justice and obstruction of justice, subornation of perjury and perjury, fraud, and witness tampering. These criminal acts involve creating a false document relative to a fraudulent stipulation of dismissal, falsifying court records, staging a phony hearing on a motion I filed and creating a fraudulent transcript and civil minutes for that hearing that contradict each other. Furthermore, the rulings of the courts in each of my lawsuits are biased in favor of the City of San Jose and they are wholly inconsistent with the indisputable facts and well established law.
            On the website of the Office of Congressional Ethics, it states that the Office of Congressional Ethics of the House of Representatives is an independent, non-partisan entity charged with reviewing allegations of misconduct against Members, officers, and staff. It is sufficiently clear that this matter is within the jurisdiction of the Office of Congressional Ethics. It is also well established that the First Amendment of the U.S. Constitution guarantees the right of the people to petition the government for a redress of grievances. The definition of redress by Merriam-Webster is to set right or remedy an unjust or unfair situation.
            It is important to note that there are no pending actions in court relative to my two lawsuits because the courts have entered their final judgments. Nothing precludes Congress from conducting investigations into my allegations against the courts based on Congress’ constitutional authority/obligation to provide oversight. It is important to keep in mind that my allegations against the courts and the City of San Jose involve very serious criminal

misconduct. In order to support my allegations of criminal misconduct by San Jose city officials and the courts are two attachments in pdf format on a flash drive that’s included in this packet. One attachment contain copies of a letter and documents sent to Inspector General Michael Horowitz alleging that former Attorney General Jeff Sessions and F.B.I. Director Christopher Wray, along with several other officials in the Department of Justice and F.B.I. are engaged in a cover-up of the criminal misconduct of San Jose city officials and federal court officials. The other attachment contains copies of a letter and documents I sent to Chief Judge Sidney R. Thomas of the Ninth Circuit Court of Appeals that is undeniable proof that the judgments in my two lawsuits against the City of San Jose are based on fraud; and that they are in violation of the Constitution and well established precedent and statutory law. The judgments are by law null and void. Yet, the courts refuse to vacate them. Also on the flash drive are copies of the complaint letters I sent to Speaker Pelosi, Chairman Nadler, and Chairman Schiff; along with copies of complaint letters I sent to Senator Lindsey Graham, Senator Dianne Feinstein, Senator Chuck Grassley, Senator Kamala Harris, Attorney General William Barr, Chief Justice John Roberts, and Ninth Circuit Court of Appeals Chief Judge Sidney R. Thomas.
The conduct of San Jose city officials and federal court officials is an egregious abuse of power that violates the public trust. What makes their conduct truly appalling is that their intent is to cover up racism, bigotry and corruption. The evidence of racism by San Jose city officials is indisputable because they state in court papers that the City’s anti-discrimination policies does not protect me, a black person, and that they had no duty to investigate my racial discrimination complaints against City officials. Even though San Jose city policy specifically states that discrimination complaints will be investigated, the courts ruled in favor of the City stating that there were no set of facts that I could allege to make my racial discrimination claim viable. It is worthy to note that state law and precedent also establish that City officials had a duty to investigate my discrimination complaints, and that they can be held liable individually under Section 1983 based on their deliberate indifference. Further evidence of bias by the courts and indifference to the City’s racist conduct is that the court in one proceeding exhibited hostility toward my discrimination lawsuit by asking why I was making this a federal case and why I didn’t just drop the darn thing (my lawsuit). Bias is also indicated by the fact that the courts ruled in favor of the City in my first lawsuit despite City officials’ admission that they had violated City policy and a state law that implicates a constitutionally protected interest. This flagrant bias against me by the courts also makes the judgments in my lawsuits null and void. 
In covering up this clear case of bigotry and public corruption, Speaker Pelosi, Chairman Nadler, and Chairman Schiff have violated the ethics rules of the House of Representatives, as well as the oath they took to protect and uphold the Constitution. A credible criminal case for collusion and obstruction of justice can also be made against Speaker Pelosi, Chairman Nadler, and Chairman Schiff because the intentional cover-up of a crime is in itself a crime. An investigation into this matter is warranted in order to protect the integrity of our judicial system and to set right this unjust situation. Please inform me of what action the Office of Congressional Ethics will take in regards to my complaint.

Dear Speaker Pelosi:

             Please be advised of the complaint that I have made with the Office of Congressional Ethics against you. My complaint is due to your repeated failures to take action on my allegations as stated in letters I sent to you dated May, 6, 2019 and June 18, 2018 that San Jose city officials and officials with the U.S. District Court and the Ninth Circuit Court of Appeals committed several criminal acts during the litigation of two discrimination lawsuits I filed against the City of San Jose. The purpose of the criminal misconduct by San Jose city officials and the courts is to cover up racism and bigotry by San Jose city officials against me based on my employment as a police officer with the City of San Jose. I am black/African American. A copy of my complaint with the Office of Congressional Ethics is included with this letter. Also included are copies of several documents on a flash drive that were submitted to the Office of Congressional Ethics that support my complaint. It is unmistakable that Members of Congress, as well as, officials with the Department of Justice and F.B.I. are engaged in a conspiracy to cover up the racism and corruption of San Jose city officials and the federal courts.
            Speaker Pelosi you and members of your party have been vocal critics of President Trump when it come to the issues of race and corruption. You have stated in the past that President Trump is a racist, and that he wants to make America white again. Even though you have not supported your party’s rush to impeach the President, you have stated that you would like to see the President in prison for obstruction of justice relative to the Mueller Investigation.
            To further paint the President as a racist, you and your party condemned the President for a tweet he sent out suggesting that four Congresswomen of color should go back to where they came from if they didn’t like it here in this country. You spearheaded the effort of Congress to pass a resolution condemning the President for his tweet against the four Congresswomen. You and your party also condemned as racist the President’s tweet against House Oversight Committee Chairman Elijah Cummings stating that Baltimore, which is located in his district, is a rat infested hell hole.
            You and your party have been quick to condemn President Trump for his tweets that are not criminal or violate anyone’s rights. Yet,  you and members of your party have refused to take any action on the flagrantly racist and criminal misconduct of San Jose city officials and officials with the U.S. District Court and the Ninth Circuit Court of Appeals that violates my due process rights, my equal protection rights, and my rights to freedom of speech. What also makes the lack of action by you and your party to protect my rights shocking and unconscionable is your efforts

to protect and provide rights to non-citizens that enter this country illegally or is here illegally because they overstayed their visas. Certainly I, a black citizen, should expect the Democratic Party to provide the same protections for my rights as is provided for non-citizens. Speaker Pelosi, it is clear from the lack of action regarding my complaints by you, Chairman Nadler, and Chairman Schiff that Democrats are not morally superior to President Trump on the issues of race and corruption. Please be aware that I have no intentions of giving up my rights relative to this matter. If Congress does not address this injustice, then I will be forced to address this matter in other lawful ways, as well as through non-violent civil disobedience.

             Please be advised of the complaint that I have made with the Office of Congressional Ethics against you, Speaker of the House Nancy Pelosi, and House Intelligence Committee Chairman Adam Schiff. Also included are copies of several documents on a flash drive that were submitted to the Office of Congressional Ethics that support my complaint.
            Chairman Nadler, you and members of your party have frequently condemned President Trump for his tweets that have been described as being racist. Two of the President’s recent tweets involve insensitive comments about four Congresswomen of color and House Oversight Committee Chairman Elijah Cummings. In a statement on the floor of Congress, you condemned President Trump’s tweet urging the four Congresswomen of color to go back to where they came from. You stated that Democrats denounce all of the offensive comments that emanate from the White House while Republicans remain silent. Yet, you and the Democrats are totally silent and refuse to respond to my complaints that San Jose city officials and officials with the U.S. District Court in San Jose and the Ninth Circuit Court of Appeals committed several felonies during the litigation of two lawsuits I filed against the City of San Jose for discrimination based on my race and disability. I am black/African American.
            I respectfully remind you of your efforts to protect and provide rights to non-citizens that are in this country illegally. Certainly I, a black law abiding citizen, should expect Democrats to protect my constitutional rights. It is clear though from the lack of action by you and members of your party that Democrats are not morally superior to President Trump on the issues of race and corruption. I also remind you that you have stated in the past that the Democrats’ impeachment inquiries are based on Congress’ obligation to provide oversight of the President. The same obligation that Congress has to provide oversight of the Executive Branch applies equally to the Judicial Branch. The Judiciary Committee, led by you Chairman Nadler, has conducted hearings into several current and former members of the Trump administration and subpoenaed several documents relative to Mueller’s investigation in an effort to build a case against the president for impeachment, under the notion that President Trump is not above the law. Yet, you and Members of Congress have taken no action against the racist and criminal misconduct of San Jose city officials and officials with the U.S. District Court and the Ninth Circuit Court of Appeals. It is clear that there is a case-fixing scheme involving courts in the Ninth Circuit that has completely undermined our democracy, the judicial system and the rule of law. Much of the evidence that proves my allegations are true is in the records of the court that is public

It is clear that the House of Representatives, under the leadership of the Democrats, has a double standard when it comes to providing oversight of the Executive and Judicial Branches of government. President Trump receives endless oversight, whereas, the federal courts receive none whatsoever. I make this stern warning. I will never give up my rights in this matter. If there is no just resolution to this matter, I will address it in other lawful ways and/or through non-violent civil disobedience.             Chairman Schiff, you are one of the biggest critics of President Trump. You have called him a racist based on his tweets and immigration policies. You have called for his impeachment based on his conduct during the Mueller Investigation. Yet, you refuse to call for an investigation into the racist and corrupt actions of San Jose city officials and officials with the U.S. District Court in San Jose and the Ninth Circuit Court of Appeals during litigation of two discrimination lawsuits I filed against the City of San Jose. I am black/African American. Your condemnation of the President as being racist and corrupt seems to be hypocritical in light of your cover up of the misconduct of San Jose city officials and the federal courts. Since all of my efforts to resolve this matter through proper legal channels have failed, please be aware of my intent to seek a just resolution through other lawful means and through non-violent civil disobedience. It Is The Democrats That Have Committed Impeachable Offenses

 In a post on July 25 of this year, I questioned the judgment of Democrats based on their efforts to uncover evidence for impeachment of President Trump by having Robert Mueller testify in an open hearing in Congress. What I stated implicitly or explicitly is that the actions of the Democrats were so driven by hate that they have become deranged and delusional. I also stated in that post that Democrats have no shame and no honor when it comes to building a case for impeachment against Trump.

Proving what I said is true, is this anonymous whistleblower complaint that came to light several days ago alleging that Trump pressured the newly elected President of Ukraine, Volodymyr Zelensky, to open an investigation into presidential candidate Joe Biden and his son Hunter Biden by withholding military aid from Ukraine during a phone call on July 25th of this year. An important fact to keep in mind is that the anonymous whistleblower had no direct knowledge of what was said during the phone call in question. Yet, Democrats, led by Speaker of the House Nancy Pelosi, opened a formal impeachment inquiry Tuesday (9/24/19) into the President, even though, they too had no knowledge of what was said in the phone call Trump had with the Ukranian president. This is  more evidence that Democrats are willing to do anything in order to impeach President Trump, even on uncorroborated allegations in an anonymous complaint. The President said in a tweet Tuesday (9/24/19) that he would release a full unredacted transcript of the phone call at the heart of this matter, and stated he was open to releasing the entire whistleblower's complaint. Yet, the Democrats, who don't really care about facts when it comes to impeaching Trump, exhibited no discipline or self-control by waiting for the facts to come out when they opened their formal impeachment inquiry.

The Democrats have a history of either destroying or attempting to destroy political opponents or those who they oppose based on uncorroborated allegations of misconduct that often times occurred decades ago. The most notable cases involve Justice Brett Kavanaugh and Judge Roy Moore. Who can forget: "I believe her." This is totally inconsistent with the values we claim to have in our republic where a person is considered innocent until proven guilty. Now they have come out in favor of this impeachment inquiry based on the fraudulent and insincere claim they are protecting our democracy. Speaker Pelosi said that it's not a good thing for democracy. Congressman John Lewis said the future of our democracy is at stake. The comments by Speaker Pelosi and Congressman Lewis are pretty much the sentiments of the overwhelming majority of Democrats. What a bunch of liars and hypocrites they are. We lost our democracy a long time ago because of public corruption.

Perhaps the most profound claim that many Democrats are using to justify an impeachment proceeding is that President Trump should be held accountable because "no one is above the law." REALLY? They make this ridiculous claim after encouraging, enticing: let's be honest, begging undocumented immigrants to break federal law by entering our country illegally at the southern border. Once these immigrants enter the country, many democratically run cities flout federal immigration law by providing sanctuary for them, even in cases where they have violated other laws once on American soil. To further show their utter contempt for our nation's sovereignty, they want to provide free health care to all undocumented immigrants and provide them many other benefits that are normally reserved for lawful residents. The only time it seems that they support the rule of law is when it comes to the conduct of President Trump.

Wednesday morning (9/25/19) President Trump released the transcript of the phone call he had with the Ukranian president. There is no evidence of a quid pro quo between President Trump and President Zelensky; even though the two discuss a potential investigation by Ukraine into Joe Biden and his son Hunter Biden. I read the entire transcript and I am speechless that the Democrats would want to impeach Trump over what was said in the phone call. How could any reasonable and rational human being say that this was a shake down by the President? Well, House Intelligence Chairman Adam Schiff did. How can can any rational human being say that Trump was pressuring the Ukranian president to investigate the Bidens or anyone else. The Democrats are. Maybe the words "can you do me a favor" and "if it's possible" have taken on a different meaning.  Later in the day on Wednesday (9/25/19), the whistleblower complaint was released. As to be expected most Republicans and Trump supporters believe that Trump did not do anything wrong; whereas, most Democrats and Trump haters believed he committed some impeachable crimes. What this means for Americans is that the impeachment inquiry by Democrats will continue indefinitely. To that end, the Director of National Intelligence was called to testify today (9/26/19) before the House Intelligence Committee headed by Democrat Adam Schiff. Folks please don't be fooled. All this impeachment nonsense is about politics and the Democrats weaponizing their constitutional authority to provide oversight of the President who is the head of the Executive Branch of government.

What is occurring is a disgrace. Like I said earlier, I read the entire transcript of the phone call in question. I can not say whether or not Trump had in the back of his mind that Joe Biden's campaign would be harmed by an investigation into his son's business dealings. However, when there is a question as to what someone said and their intentions, you look at the actual words that were uttered. And looking at the words of President Trump and President Zelensky the reasonable conclusion is that they were talking about rooting out corruption. Nevertheless, Trump should accept some of the blame for this spectacle. As is always the case with politics, appearance is everything. Trump has every right to have the actions of Joe Biden investigated based on Biden's own admission that there was a quid pro quo arrangement between the US and Ukraine over millions of dollars in aid. There is a legitimate question whether or not Biden's son Hunter benefited financially from the elder Biden's quid pro quo. Certainly, no reasonable person is going to suggest that being a presidential candidate is some type of immunity or shield from a corruption investigation. Don't Democrats and their supporters in the media remember that the Trump campaign was investigated after he had already secured the Republican nomination? Much of the information, albeit it false, used to initiate that investigation ironically came from the Ukraine. The Joe Biden campaign should not be treated any different from the Trump campaign. However, knowing that everything he says will be hyper scrutinized, and knowing that any number of people are willing to leak the content of his confidential conversations, and knowing that the Democrats are willing to characterize anything he says and does as misconduct, Trump should accept the clear fact that he is partly to blame for his predicament. This was a temporary lapse in judgment by bringing up the Bidens in a conversation about an investigation, knowing that his haters would perceive this as election meddling. But it is clearly, without any thing else, not a situation that calls for impeachment. The Democrats know that very well, and I'm sure they will keep looking.

For me, this is about more than an impeachment inquiry. I am troubled by the way this whistleblower complaint is being treated compared to the way several public corruption complaints I  filed against San Jose city officials, officials with the US District Court, and the Ninth Circuit Court of Appeals have been handled by several government officials in Washington, DC, including Speaker of the House Nancy Pelosi, House Intelligence Committee Chairman Adam Schiff, and House Judiciary Committee Chairman Jerrold Nadler. I mention these three by name at this point because they are the ones spearheading the impeachment inquiry against the President.

My public corruption complaints allege that my former attorney (Stuart Kirchick), San Jose Mayor Sam Liccardo, the San Jose City Council, San Jose City Attorney Richard Doyle and several attorneys with the City of San Jose, and three retired San Jose police administrators (Chief of Police Rob Davis, Assistant Chief of Police Tuck Younis, and Deputy Chief of Police Adonna Amoroso) conspired with the US District Court in San Jose, and the Ninth Circuit Court of Appeals to hide racist and bigoted actions taken against me by the above named San Jose city officials, during the litigation of two discrimination lawsuits I filed against the City of San Jose . In my complaints, I allege that the above officials committed several felonies that include fraud (creating false documents and conducting a fake court proceeding on a motion I filed), subornation of perjury and perjury, bribery, conspiracy to obstruct justice and obstruction of justice, and witness tampering. I also alleged that the decisions in my lawsuits by the US District Court and the Ninth Circuit Court of Appeals were flagrantly biased and totally inconsistent with the facts and well established precedent and statutory laws. Additionally, I alleged that the San Jose Police Department investigated me for criminal misconduct or a security risk based on two non-threatening emails I sent to Mayor Liccardo and San Jose City Council Members.This was done to intimidate me and to have a chilling effect on my freedom of speech.

How does this relate to the whistleblower complaint that's at the center of this impeachment inquiry? It is how Speaker Pelosi, Chairman Nadler, and Chairman Schiff have reacted to the whistleblower complaint compared to public corruption complaints I made with them against the San Jose city officials and the federal court officials mentioned above. The impeachment inquiry was started by Democrats based on their dubious claims that they take their oaths of office seriously; and that they have a constitutional obligation to hold President Trump accountable for his abuse of power. As stated already they say that no one is above the law, not even the President. I have already proved that this is a lie by pointing out that they have literally begged undocumented immigrants to break federal law and come into this country illegally. My biggest concern is the treatment of the whistleblower complaint by Speaker Pelosi, Chairman Schiff, and Chairman Nadler compared to how they have treated my complaint. The whistleblower complaint and my complaint both alleges, potential criminal activity, an abuse of power, a quid pro quo, national security implications because the misconduct alleged poses a threat to our democracy, and a cover up. However, there is a huge difference between my complaint and the anonymous whistle blower complaint. My complaint is not anonymous. I provide my name and make myself available for contact in order to provide additional information. I have firsthand information regarding my allegations. In fact, I am the victim of the alleged misconduct that was based on my race and disability. I am black/African American. My complaints states specific crimes that were committed. I provided incontrovertible evidence with my complaints in order to corroborate the crimes I allege. The whistleblower's complaint does not state specific crimes allegedly committed by the President, and did not have corroborating evidence for any of the claims listed. I suffered a significant financial loss and experienced extreme emotional distress that was inflicted intentionally by the accused officials. It is unknown if the whistleblower suffered any damages.

It is not my intent to suggest that the whistleblower's complaint didn't deserve the special treatment it received. However, when compared to the transcript of the call between President Trump and President Zelensky, the allegations in the complaint seems overblown and exaggerated. When comparing the allegations in my complaint to the evidence I submitted to corroborate them, the allegations in my complaints are understated. Yet, Speaker Pelosi, Chairman Schiff, and Chairman Nadler were aggressive in their push for an impeachment inquiry even before receiving the transcript or the complaint. As for my complaint, I have not received a response from Speaker Pelosi, Chairman Nadler or Chairman Schiff; even though, they document an abuse of power far more reprehensible than what has been established by the anonymous whistleblower's complaint and the transcript of the call between President Trump and President Zelensky. What the Democrats are asking Americans to do in regards to the whistleblower's complaint and the transcript of the phone call is to believe what they say and not what you read. They want you to believe that the transcript is proof that there was pressure put on the Ukranian President by President Trump to investigate the Bidens in order to corruptly influence the 2020 elections. The  transcript simply does not support that claim. More importantly, President Zelensky states unequivocally that he was not pressured on that call. However, I have an open mind and I am willing to listen to any other evidence that might prove President Trump committed impeachable offenses.

Both Speaker Pelosi and Chairman Schiff have stated in interviews today that the White House is engaged in a cover up, and that Director of National Intelligence Joseph Maguire committed a crime by not immediately transferring the whistleblower's complaint to Congress. Yet, it is they who have committed a crime and betrayed their oath of office by covering up an abuse of power scandal involving several San Jose city officials, the US District Court in San Jose, and the Ninth Circuit Court of Appeals. The evidence is incontrovertible that these two courts engage in case-fixing; and that many cases, primarily pro se, are disposed of by court personnel other than judges with summary dispositions that are not in line with the precedent of the Supreme Court or the Ninth Circuit Court of Appeals. It is Speaker Pelosi, Chairman Schiff, Chairman Nadler, along with several other officials, Republican and Democrat, elected and appointed that have committed impeachable offenses far more egregious than any potential misconduct by President Trump in his phone call with President Zelensky of Ukraine. Re: Ethics Violations by Members of the House of Representatives

Dear Members of the Office of Congressional Ethics:

            I respectfully request that your office conduct an investigation into ethics violations and criminal misconduct by the following Members of the House of Representatives and/or their staffs: Speaker of the House Nancy Pelosi, Chairman of the House Judiciary Committee Jerrold Nadler, and Chairman of the House Intelligence Committee Adam Schiff. I am alleging that Speaker Pelosi, Chairman Nadler, Chairman Schiff, and/or members of their staffs are engaged in a cover-up of racism and criminal misconduct by San Jose city officials, officials with the U.S. District Court for the Northern District of California – San Jose Division and the Ninth Circuit Court of Appeals that occurred during litigation of two lawsuits I filed against the City of San Jose for racial and disability discrimination. I am black/African American. Speaker Pelosi, Chairman Nadler, and Chairman Schiff failed to take action on letters I submitted to each detailing the racist and criminal acts perpetrated by San Jose city officials and officials with the U.S. District Court and Ninth Circuit Court of Appeals. The criminal misconduct by San Jose city officials and the courts include bribery, conspiracy to obstruct justice and obstruction of justice, subornation of perjury and perjury, fraud, and witness tampering. These criminal acts involve creating a false document relative to a fraudulent stipulation of dismissal, falsifying court records, staging a phony hearing on a motion I filed and creating a fraudulent transcript and civil minutes for that hearing that contradict each other. Furthermore, the rulings of the courts in each of my lawsuits are biased in favor of the City of San Jose and they are wholly inconsistent with the indisputable facts and well established law.
            On the website of the Office of Congressional Ethics, it states that the Office of Congressional Ethics of the House of Representatives is an independent, non-partisan entity charged with reviewing allegations of misconduct against Members, officers, and staff. It is sufficiently clear that this matter is within the jurisdiction of the Office of Congressional Ethics. It is also well established that the First Amendment of the U.S. Constitution guarantees the right of the people to petition the government for a redress of grievances. The definition of redress by Merriam-Webster is to set right or remedy an unjust or unfair situation.
            It is important to note that there are no pending actions in court relative to my two lawsuits because the courts have entered their final judgments. Nothing precludes Congress from conducting investigations into my allegations against the courts based on Congress’ constitutional authority/obligation to provide oversight. It is important to keep in mind that my allegations against the courts and the City of San Jose involve very serious criminal

misconduct. In order to support my allegations of criminal misconduct by San Jose city officials and the courts are two attachments in pdf format on a flash drive that’s included in this packet. One attachment contain copies of a letter and documents sent to Inspector General Michael Horowitz alleging that former Attorney General Jeff Sessions and F.B.I. Director Christopher Wray, along with several other officials in the Department of Justice and F.B.I. are engaged in a cover-up of the criminal misconduct of San Jose city officials and federal court officials. The other attachment contains copies of a letter and documents I sent to Chief Judge Sidney R. Thomas of the Ninth Circuit Court of Appeals that is undeniable proof that the judgments in my two lawsuits against the City of San Jose are based on fraud; and that they are in violation of the Constitution and well established precedent and statutory law. The judgments are by law null and void. Yet, the courts refuse to vacate them. Also on the flash drive are copies of the complaint letters I sent to Speaker Pelosi, Chairman Nadler, and Chairman Schiff; along with copies of complaint letters I sent to Senator Lindsey Graham, Senator Dianne Feinstein, Senator Chuck Grassley, Senator Kamala Harris, Attorney General William Barr, Chief Justice John Roberts, and Ninth Circuit Court of Appeals Chief Judge Sidney R. Thomas.
The conduct of San Jose city officials and federal court officials is an egregious abuse of power that violates the public trust. What makes their conduct truly appalling is that their intent is to cover up racism, bigotry and corruption. The evidence of racism by San Jose city officials is indisputable because they state in court papers that the City’s anti-discrimination policies does not protect me, a black person, and that they had no duty to investigate my racial discrimination complaints against City officials. Even though San Jose city policy specifically states that discrimination complaints will be investigated, the courts ruled in favor of the City stating that there were no set of facts that I could allege to make my racial discrimination claim viable. It is worthy to note that state law and precedent also establish that City officials had a duty to investigate my discrimination complaints, and that they can be held liable individually under Section 1983 based on their deliberate indifference. Further evidence of bias by the courts and indifference to the City’s racist conduct is that the court in one proceeding exhibited hostility toward my discrimination lawsuit by asking why I was making this a federal case and why I didn’t just drop the darn thing (my lawsuit). Bias is also indicated by the fact that the courts ruled in favor of the City in my first lawsuit despite City officials’ admission that they had violated City policy and a state law that implicates a constitutionally protected interest. This flagrant bias against me by the courts also makes the judgments in my lawsuits null and void. 
In covering up this clear case of bigotry and public corruption, Speaker Pelosi, Chairman Nadler, and Chairman Schiff have violated the ethics rules of the House of Representatives, as well as the oath they took to protect and uphold the Constitution. A credible criminal case for collusion and obstruction of justice can also be made against Speaker Pelosi, Chairman Nadler, and Chairman Schiff because the intentional cover-up of a crime is in itself a crime. An investigation into this matter is warranted in order to protect the integrity of our judicial system and to set right this unjust situation. Please inform me of what action the Office of Congressional Ethics will take in regards to my complaint.

The Democrats Continue to Make Fools of Themselves With This Mueller Hearing

I'm not going to tell anyone who to vote for or what party to support. I have already stated in prior posts that I have no preference for neither the Democratic Party nor the Republican Party. As far as I'm concerned, they are on the same page when it come to corruption. Both parties are corrupt to their cores and they care nothing about the rights of the American people. I also stated in prior posts that I believe that public corruption is the greatest threat to democracy, not Donald Trump, not the Russians, not Iran or North Korea, and not China. Now all this could change in the blink of an eye. But as we stand today, it's crooked and corrupt government officials elected and appointed that pose the greatest existential threat to Democracy and the Constitution which is the foundation for our rule of law. I know some smarty pants out there is going to point out my apparent inconsistent statement because obviously Trump is an elected official. The reason Trump is less of a threat to democracy and the Constitution than other government officials is the abundance of oversight that is exercised over all of his actions. Nearly everything he does is met with resistance by the Democrats and the mainstream media or by a court challenge from progressive leaning groups. No other officials in our government come close to getting the same oversight as President Trump.

Now about this spectacle that went on in Washington, DC today that was the Mueller Hearing. We all know about Mueller's probe into possible collusion between the Trump Administration and the Russians during the past presidential election, and allegations that Trump attempted to obstruct Mueller's investigation. For the life of me, I can't understand why the Democrats continue to push this nonsense surrounding Mueller's probe. Democrats have no shame and no honor when it comes to their desire to build a case for impeaching President Trump. It's no wonder the Bible warns against hate. Hate is truly a bad thing, and the Democrats are a prime example of how bad it is to be full of hate. They have become totally irrational, unhinged, deranged and consumed behind Mueller's investigation which found that there was no collusion between Trump and the Russians. All Democrats have left is a possible obstruction case that is weak at best.

First of all, it was clear during the Obama Administration that there was no collusion between Trump and the Russians, and that Russia's attempt at meddling in our election had no impact on the outcome of the election. Let us use some commonsense here. There were several investigations by intelligence officials, Congress, and the FBI into this matter. Not a single piece of evidence was uncovered that Trump or any members of his campaign colluded. There was absolutely no need for a Special Counsel investigation. The Special Counsel was appointed only after FBI Director James Comey was fired and he leaked a letter to the press suggesting that Trump had tried to obstruct justice in the Michael Flynn case. If Comey had not been fired, we would not have had to suffer through Mueller's investigation and all of the spectacles attendant to it; namely the testimony of  Trump's former lawyer Michael Cohen, Attorney General William Barr, and now Robert Mueller himself. Plain and simple, the Mueller investigation was a farce and was retaliation for the firing of James Comey by Trump.

I stated in a post on June 6, 2019 that there could not be a lawful obstruction case brought against Trump because the underlying investigation is based on fraud and justice was never the intent. I compared an obstruction case against Trump to the case of a police officer making an unlawful arrest. A person can't be charged lawfully for resisting an unlawful arrest. That is just the truth. It's not about whether you like or dislike Donald Trump. This is about being honest with yourself and saying what is right. The Democrats continue to make fools of themselves by conducting this hearing today before the House Judiciary and Intelligence Committees for the purpose of gathering evidence for impeachment. The hearing today was unnecessary because Mueller stated that he would only testify to what was in his report. There was nothing new to gain in the way of evidence against Trump. Mueller pretty much kept his word and stuck to what was in his report during his testimony. The hearing made for good political theater but produced no significant new evidence that favors impeachment for obstruction of justice. As I just pointed out, any case brought against Trump  for obstruction would be moot from the standpoint that the underlying investigation was not legit. Fraud vitiates everything!

I believe the Democrats are making fools of themselves for other reasons. It is clear from their tolerance for prior cases of obstruction of justice that their obsession with the weak obstruction case against the President is politically motivated and insincere. I gave two such examples of solid obstruction of justice cases in my post on June 6, 2019 that the Democrats were unwilling to call for any prosecution or accountability. One case involved the Hillary Clinton email scandal. You would be hard pressed to find a more flagrant case of obstruction of justice. The evidence was quite compelling: thirty thousand emails deleted that were under subpoena, computer hard drives were wipe clean, and communication devices containing material evidence were smashed to bits. Destroying evidence in a criminal investigation is classic obstruction of justice. Yet, the same Democrats were quick to defend Clinton; and they now want to impeach Trump for far less reprehensible conduct than Clinton. The second case I mentioned in my post on June 6, 2019 involves a conspiracy by Democrats and Republicans to cover up an obstruction of justice and case-fixing scheme involving several San Jose city officials, officials with the US District Court in San Jose and the 9th Circuit Court of Appeals. The Democrats who are now seeking to impeach Trump have failed to call for an investigation into the egregious conduct of San Jose city officials and federal court officials. The Democrats would be wise to think twice before proceeding with this foolhardy impeachment nonsense.

Democrats' Problem With Impeachment

Lately, I haven't heard much coming from the Democratic leadership in Congress about impeaching President Trump. What is going on? A few weeks ago all you heard from many of the Democrats was how Trump deserved to be impeached based on his obstructive conduct during the Mueller Investigation. I think we all are familiar with Trump's alleged misconduct documented in Mueller's report. I don't have to state it here. I have already stated in prior posts in this blog why I believe impeachment is not a good idea. You will also find in many of my prior posts that I bash the Democrats for their hypocrisy and dishonesty. There is a good reason for my Democrat bashing. They deserve it. To her credit, Nancy Pelosi, the Speaker of the House, has always stated that she was against impeachment. However, many other leading Democrats in Congress were initially very enthusiastic about this impeachment nonsense. This enthusiasm seems to have tapered off. Democrats like Senators Cory Booker and Kamala Harris, members of the Senate Judiciary Committee; along with House Judiciary Committee Chairman Jerry Nadler, House Oversight and Reform Committee Chairman Elijah Cummings and House Intelligence Committee Chairman Adam Schiff have all been very forceful in their support for the impeachment of President Trump. The reasons given for impeachment range from holding the President accountable for his crimes, Congress' obligation under the Constitution to exercise oversight of the President and because of the notion that no one is above the law. Now these would all be good reasons to impeach Trumps if in fact his conduct reached the high standard for impeachment set by the Constitution that requires treason, bribery or high crimes and misdemeanors. Just as I believed with Bill Clinton, I don't think the constitutional standard is met with Trump's conduct. I have said this before and I am saying it again. My position on impeachment and my condemnation of the Democrats' hysteria surrounding Trump's conduct should not be taken as my support for Trump. The Democrats are all about putting on a show for the media and for their base of Trump haters. They should not be taken serious about anything, clearly not about impeachment. 
As I note in the title of this post, the Democrats have a huge problem with impeachment. Many of the top Democrats in Congress, Speaker Pelosi, Senators Dianne Feinstein and Kamala Harris, House Judiciary Committee Chairman Jerry Nadler and House Intelligence Committee Chairman Adam Schiff are part of a criminal conspiracy by members of Congress to obstruct justice by covering-up several felonies committed by San Jose city officials and several federal court officials during litigation of two racial and disability discrimination lawsuits I filed against the City of San Jose. I am black/African American. It is the misconduct of the Democrats that I just mentioned that rises to the constitutional standard for impeachment, high crimes and misdemeanors. It is they who are more deserving of impeachment than President Trump. Speaker Pelosi, Senators Feinstein and Harris, Congressmen Nadler and Schiff all received letters from me asking that the Senate and House Judiciary Committees open investigations into my allegations against San Jose city officials and the federal courts. No investigation has been opened, even though I presented each with incontrovertible facts and evidence to support my allegations. The facts and evidence I presented prove without a shadow of doubt that San Jose city officials conspired with my attorney and the courts to falsify court records, create false documents, and stage a phony hearing on a motion I filed. A fraudulent transcript and civil minutes were then created for that hearing. At least one city official and my attorney was bribed for their participation. In addition to the criminal acts committed, the courts failed to follow several federal statutes and binding precedent while making rulings in favor of the City of San Jose in both of my lawsuits.
The Democratic leadership in Congress should be very careful with how they handle this move to impeach President Trump based on the impeachable offenses they are committing by covering up the very egregious conduct of the City of San Jose, the US District Court and the 9th Circuit Court of Appeals. Not only would they look like hypocrites if they impeach Trump, there could be political and legal ramifications for them as well for their criminal cover-up. They should be aware that I have no intent of allowing this scandal to simply be ignored. They have reason to worry.

YOU CAN'T OBSTRUCT JUSTICE WHEN THERE IS NO JUSTICE TO OBSTRUCT

Just when you think you've seen it all when it come to hatred for Donald Trump, you get this statement supposedly signed by several hundred former federal prosecutors stating that they believe the conduct of President Trump described in Special Counsel Robert Mueller's report would, in the case of any other person not covered by the Office of Legal Counsel policy against indicting a sitting President, result in multiple felony charges for obstruction of justice. These former prosecutors, if in fact they are former prosecutors, are all big liars. This ridiculous statement has zero credibility from the word go. I know a solid one half of the country, maybe more, will buy into this false narrative being pushed by these presumed to be former prosecutors. At least one Republican Congressman has joined the Democrats in support of this lie. But I am going to completely destroy their claim with facts that are hard to dispute.

I'm no big fan of the President. But I don't hate him. I was no big fan of Hillary Clinton. But I don't hate her. I'm no fan of Nancy Pelosi and the Democrats. But I don't hate them. I'm no fan of Lindsey Graham and the Republicans. But I don't hate them. Here is the point I'm painstakingly trying to make. I don't take sides when it comes to politicians and government officials. I am a tribe of one. I only take the side of what I believe is right. My response to this statement purportedly made by these persons claiming to be former federal prosecutors is not about defending or showing support for Trump. It is about exposing the lack of integrity and honesty of these so called former prosecutors.

As I promised, I'm going to destroy the ridiculous claim by these so called former prosecutors that any other person that's not President Trump would be indicted on multiple charges for obstruction of justice. The basis of their claim is that the Mueller report describes several acts that satisfy all the elements for an obstruction charge: conduct that obstructed or attempted to obstruct the truth-finding process, as to which the evidence of corrupt intent and connection to pending proceedings is overwhelming.

Here's where the false narrative falls apart. First and foremost, it is not possible from a legal standpoint to obstruct justice during an investigation that's illegitimate, and is based on fraud and justice was never the intent. It is similar from a legal standpoint that you can't be guilty of resisting an arrest that is unlawful. I could rest my case now, but the best is yet to come. Doesn't these so called former prosecutors remember the Hillary Clinton email investigation? After she was issued a subpoena to preserve evidence, she deleted over thirty thousand emails, destroyed computer hard drives and other communications devices with the clear intent to obstruct the truth-finding process. I think the chances are one hundred percent that there was classified information in those deleted emails and communication devices that were destroyed. The evidence of her corrupt intent and the connection to a pending proceeding was overwhelming and indisputable. Since Hillary Clinton was a person not covered by the Office of Legal Counsel policy against indicting a sitting President, why wasn't she indicted? The fact that Clinton wasn't indicted discredits the claim that any other person would have been charged under similar circumstances described in Mueller's report. The case for obstruction against Clinton was a lot stronger than the case for obstruction against Trump. Yet, over half of the voters and all of the Democratic elected officials in Congress were willing to elect her President. Now you have a significant number of Democratic Members of Congress wanting to impeach Trump for conduct far less reprehensible than Clinton's. I could rest my case here, but I'm not; because the evidence that proves that these so-called former prosecutors are liars gets even better.

Beginning in 2014, long before there was a Trump Presidency, I filed a complaint with the Department of Justice and the F.B.I. against San Jose city officials and officials with the U.S. District Court and the Ninth Circuit Court of Appeals based on their conduct during the litigation of a lawsuit I filed against the City that obstructed justice. The evidence that these officials obstructed justice is extensive and demonstrates a total disregard for the judicial process and the rule of law. Now keep in mind the elements of an obstruction charge according to the so-called former prosecutors: conduct that obstructed or attempted to obstruct the truth-finding process. During litigation of my lawsuit, the City of San Jose ("City") and the U.S. District Court in San Jose conspired to obstruct the truth-finding process. Two City officials were told to lie under oath during their depositions. They, in fact, told several lies on material issues during their depositions. The District Court essentially ordered the City to file a motion for summary judgment that was a total fabrication. The City was allowed to enter into a fraudulent agreement with my attorney, who received a quid pro quo, to dismiss a defendant that clearly violated my rights. The purpose of this dismissal was to prevent the court from ruling on the discriminatory acts of the defendant and his superior. The facts alleged in the City's motion for summary judgment were not only false, they contradicted the true facts the City had already admitted to in it's answer to my complaint/lawsuit. To put it plain and simple, the District Court told the City to lie in it's motion for summary judgment, and to enter the fraudulent stipulation of dismissal with my attorney. Of course, the City's motion was granted by the District Court. Now how's that for obstructing the truth-finding process? But there's a lot more. After I filed my own motion under FRCP Rule 60 seeking relief from the judgment of the District Court based on the fraud that was perpetrated, the District Court and the City further obstructed justice by falsifying several docket entries by falsely stating that my motion was contesting the court costs awarded to the City, instead of fraud. I was told by a court official on two different occasions that there would be no hearing on my motion; and that my motion would be decided on the papers filed by me and the City. In clear contradiction of what I was told, a hearing was held on my motion without my knowledge. During the hearing, the City was granted a motion to dismiss because I failed to appear for the hearing, even though, I was told specifically that I did not have to appear for the hearing. The word for word account of the City's motion to dismiss was left out of the transcript of the hearing. The City's motion to dismiss supposedly made during the hearing is a complete mystery. The civil minutes reflects that something totally different happened during the hearing on my motion when compared to the transcript. The civil minutes reflects that the court ruled during the hearing that it would deny my motion and submit a written order at a later date. It is indisputable that the conduct of San Jose city officials and officials with the U.S. District Court as described above meets and exceeds the elements for an obstruction charge outlined in the statement of these so called former prosecutors.Yet, my complaints to the Department of Justice , the F.B.I, and the U.S. Attorney's Offices in San Francisco and San Jose have not been investigated, have not resulted in any indictments, nor have I received a response stating why there hasn't been any action taken on my complaints.

What has been presented here are the incontrovertible facts that discredit the claim by these so called former prosecutors that the conduct of President Trump as described by Mueller would have resulted in an indictment for any other person not covered by the Office of Legal Counsel policy against indicting a sitting President.These alleged former prosecutors are Trump haters and members of the Liars' Club with an ax to grind. For me, it's not about Trump, Clinton, the Democrats or Republicans. The reason I'm responding to this lie by these claiming to be former prosecutors is that I expected that, as a black person that grew up in the South during Jim Crow and the Civil Rights era, the federal courts would protect my constitutional rights. This has been the farthest thing from the truth. What happened to me when I sued the City of San Jose for violating my rights based on my race and disability is a disgrace. As I described above, City officials and officials in the U.S. District Court went out of their way to obstruct the truth-finding process with the corrupt intent to obstruct justice by covering up the racism and bigotry of the City. Not only am I angered by the false statement by these so called former prosecutors, I'm deeply offended as well. I now rest my case. It's Public Corruption Stupid!

 This past Friday (2/16/18), a grand jury, at the request of Special Counsel Robert Meuller, indicted 13 Russian nationals and three Russian companies for meddling in the past presidential election through the use of social media.Those indictments appears to be nothing more than a political statement and publicity stunt that's meant to distract attention from the many scandals now plaguing the FBI and DOJ. There is a very slim chance that the Russians will be brought to trial on any of the charges in the indictments because it is unlikely they will be extradited to this country. Yet, many members of Congress and the media were pleased to learn about the indictments. It's unbelievable that many of them continue to express outrage at Russia's meddling into our election when all of the evidence presented so far shows that it had little to no impact on the outcome of the election. Their support of Meuller's investigation is based on the belief that we were attacked by the Russians when they interfered in our election. There is also support by some because it puts Trump in the hot seat. As for me, I'm highly suspicious about the Meuller investigation. It was started when fired FBI director James Comey leaked a memo to the media suggesting that Trump tried to shut down the investigation into fired NSA director Michael Flynn. Comey even admits that he leaked the memo in order that a special counsel would be appointed. Had Comey not been fired, there would be no special counsel investigation into possible Trump-Russia collusion. Because the investigation appears to be in retaliation for the Comey firing, it does not excite me at all, even though I believe that Comey should not have been fired. The big question for me is why was there no concern from politicians and the media about Trump colluding with the Russians prior to him firing Comey?

To me, it has always been dubious that Russia's meddling posed such a great threat to our democracy. I wrote a post on July 31, 2017 and another one on August 26, 2017 explaining my position that this scandal might be overblown and that there were other threats to our democracy greater than Russia's interference in our past presidential election. Some of you might remember the slogan from one of former president Bill Clinton's campaigns stating "t's the economy stupid." So if you ask me what is a greater threat to our democracy than the Russian interference in our past election, "It's public corruption stupid."
