Joe Biden Is Running A Shameful Campaign About Race
Recently former Vice-President Joe Biden, a Democrat, entered the race for President. If you know anything about politics, you are aware that the former VP was a long time Senator from Delaware. I have no personal ill will toward Joe Biden. He seems like a nice enough guy. It is clear though that Biden's campaign will try to paint Trump as a racist and also focus on his character. When Biden released a video a few weeks ago announcing that he was running for president, he talked about Charlottesville and Trump's response to the violence that occurred. I have my own take of Trump's response to Charlottesville that's a little different from Joe Biden's. The President's response was appropriate being that he is the Commander-in-Chief. You can view my non-politically motivated take on how the President responded to Charlottesville in my post on September 18, 2017. Biden has also talked about bringing back honesty and dignity to the Office of the President.
Joe Biden is the quintessential politician, willing to say anything to get a vote. His candidacy is not about making this a better country. It is all about defeating Donald Trump at all costs. Biden has spent nearly fifty years in public office. He is far more responsible for the problems we face as a nation than Trump. But it's Biden's hypocrisy that concerns me the most. He talked about bringing dignity and honesty to the Oval Office. Where was all this concern for dignity when his fellow Democrat Bill Clinton was President. Has Biden forgot about the Monica Lewinsky affair and all of the other sexual misconduct allegations against Clinton. As for honesty, Biden apparently has forgotten "I did not have sex with that woman." What about the lies that were told about Obama Care when Biden was VP? If you want your doctor you can keep your doctor. Your insurance premiums will go down. And what about Benghazi? The violence was a spontaneous response to an anti-Islamic video. Biden referred to Trump as being a clown. Hasn't he taken notice of his own party since Trump has been in the White House? Who can forget the clownish manner of the Democrats during the Kavanaugh hearings or during the recent testimony of Attorney General William Barr. You actually had a Democrat member of the House Judiciary Committee eating KFC during the hearing. He also had a fake chicken at a press conference. Now who are the real clowns?
I do not offend easily. But it's the hypocrisy of Joe Biden and the Democrats regarding the issue of race that offends me more than the President and Democrats' clown like behavior. Referring to the President as the Grand Wizard of 1600 Pennsylvania Ave, the KKK, and a white supremacist for political gain trivializes one of the darkest moments in our nation's history. It is Biden latest comment during a political rally in South Carolina that has gotten me riled up. During that rally, Biden implied that because of Trump and the Republicans support of voter ID laws, "You've got Jim Crow sneaking back in." This is nonsense. Jim Crow was, among other things, about using intimidation and violence to prevent blacks from registering to vote, and from voting. Requiring a person to have proper ID in order to vote is just as sensible as requiring a person to have proper ID when purchasing a firearm. Biden and the Democrats should remember that it was their party that gave us Jim Crow, and not the Republicans. Democrats should also remember that many in their own party refused to support the 1964 Civil Rights Act that ended Jim Crow.
If Biden wants to blame someone for Jim Crow sneaking back in, he need only to look at members of his own Democratic Party. During the past three years, I have written letters to Speaker of the House Nancy Pelosi, Senators Dianne Feinstein and Kamala Harris, Congressman Adam Schiff and Congresswoman Zoe Lofgren requesting that they open an investigation into a criminal conspiracy between San Jose city officials and officials with the U.S. District Court and Ninth Circuit Court of Appeals to obstruct justice during the litigation of two lawsuits I filed against the City of San Jose. During litigation, these officials conspired to falsify court records, file fraudulent documents, stage a fake hearing on a motion I filed, fabricate contradictory civil minutes and a transcript for that hearing, and enter several bogus judgments relative to my lawsuits for the purpose of covering up discrimination I suffered at the hands of San Jose city officials based on my race and disability. I am black/African American. Senator Feinstein was the only one that responded to my letter. But she offered no help at all. The conduct of these officials, which showed utter disregard for the rule of law, were so flagrantly discriminatory and racist that I was compelled to start this blog to expose this egregious abuse of power and public corruption. The clear purpose of these officials was to humiliate me, make me feel powerless, cause me financial harm and emotional distress. This is more like Jim Crow than requiring someone to have proper ID to vote.
Joe Biden and the Democrats using race for purely political reasons is divisive and harmful to our country. They are quick to call Trump and Republicans racist, the KKK, white supremacists, and that Jim Crow is sneaking back in. Yet, when presented with a very real case of a black person's rights being violated like this was Jim Crow, they refuse to take any action whatsoever; even in a case where there was serious criminal misconduct. It should be clear that Democrats are not serious about eliminating racism and discrimination, and that they are only using race to gin up hatred for Trump and Republicans. What a shame.

Words Now Speak Louder Than Actions - The Sad Reality About Race In America
I think we all have heard the old cliche that "actions speak louder than words. Clearly that no longer is the case. In this crazy world we live in today words now speak louder than actions. I make this claim based on the numerous occasions that a dumb stupid comment by a prominent person has caused an uproar. The latest example of this is the comment by actress and comedian Roseanne Barr. Roseanne tweeted a comment a few days ago about former President Barack Obama's senior adviser Valerie Jarrett. The tweet that Roseanne says was a joke goes like this: "Muslim brotherhood & planet of the apes had a baby=vj." As expected, you got social media all up in arms claiming to be so offended by by Roseanne's tweet, which they have turned into this big "racist" incident. Even though Roseanne immediately apologized, ABC cancelled her top rated show and made an obligatory statement condemning her clearly inappropriate tweet. ABC had no choice but to cancel Roseanne's show because of political correctness and to avoid protests from the usual race hustlers. But I'm totally sick and tired of the phony outrage I see by so many celebrities, media types and politicians every time some public figure says something dumb about a black person. I understand that words can be hurtful, but this response to Roseanne's tweet is over the top, just as the response to President Trump's alleged s---hole comment, just as the response to former Los Angeles Clippers' owner Donald Sterling comment about black men, as well as, the numerous other racially insensitive comments by politicians and celebrities that have been exploited by the media.
This over the top response by the media, politicians and celebrities to Roseanne Barr's stupid tweet is all about politics. These folks don't care about racism and eliminating racial discrimination in this country. They are demonizing Roseanne because of her vocal support for President Trump. This is what happens to people that come out in support of the President. Look at what happened to Kanye West and other public figures that support President Trump. Don't get me wrong. Roseanne's tweet should have consequences. However, I feel confident that had Roseanne been a Trump hater, the consequences of her tweet would not be as severe. The proof is Bill Maher's claim that he is a " house N-word." Since Maher is a Trump hater, the response to his stupid comment was nothing near the response to Roseanne's tweet. Double standard aside, the point I'm trying to make here is that we as a nation seem to be moved more by words than actions. For the past several years, I have been trying to expose flagrantly bigoted and racist treatment I suffered at the hands of several San Jose city officials, including current mayor Sam Liccardo and the rest of the San Jose City Council. I am black/African American. The clear intent of these officials was to humiliate me and to make me feel powerless in the same way blacks were humiliated in the South during Jim Crow. Not only that, they violated several of my constitutional rights knowingly and are now engaged in a criminal conspiracy with the federal courts to cover up their bigoted and racist acts. Even though the racist and bigoted treatment I experienced at the hands of San Jose city officials and the federal courts is truly appalling and repulsive, there has been no outrage or a call for an investigation from the many politicians and media outlets I have contacted. We have all this phony outrage over a dumb tasteless joke by a mentally deranged actress/comedian , even though she committed no crime or violated anyone's constitutional rights. Yet there is complete silence in response to the clearly bigoted and racist acts of San Jose city officials and the courts that clearly violate my constitutional rights. This is like being outraged over hearing someone call a black man the N-word while not being outraged at seeing a black man being lynched by the KKK. The sad reality is that words now speak louder than actions when it comes to race in America.

More Hypocrisy by San Jose Mayor Sam Liccardo
A few days ago a local San Jose Metro Newspaper (San Jose Inside) reported on a letter by San Jose Mayor Sam Liccardo "blasting" campaign promises by president-elect Donald Trump. Mayor Liccardo made promises to protect residents of San Jose from Trump's policies, mostly relating to immigration. Mayor Liccardo made two promises in that letter that really got my blood boiling. He stated: We will Not Tolerate "Hate Crimes" in San Jose and We Will Protect the Constitutional Rights of San Jose Residents. Mayor Liccardo makes these vows as he and the City Council are covering up bigoted, retaliatory and hateful acts against me by the City Attorney's Office and three former police administrators. These City officials flagrantly violated my constitutional rights. Mayor Liccardo and the City Council refused to investigate my complaints against these bigoted officials as is required by state law and city policy. US District Judge Ronald M. Whyte Violation of My Rights Conjures Up Memories of Jim Crow

If you have read any of my prior posts, you should know that the purpose of this blog is to expose cheating by the federal courts and the San Jose City Attorney's Office during litigation of a federal lawsuit I filed against the City of San Jose in 2006 for racial and disability discrimination. I am black/African American. US District Judge Ronald M. Whyte presided over the lawsuit. Judge Whyte is also at the center of another big corruption scandal as well. Judge Whyte is a renowned intellectual property jurist, and he holds many distinguished positions relative to his profession. However, it is unmistakable that Judge Whyte is corrupt and has very little respect for civil rights and the rule of law. His lack of regards for my civil rights, a black person, draws comparison to the lack of regard for civil rights of black people during Jim Crow. This comparison might seem hyperbolic, but I think it is a fair one. My comparison of Judge Whyte's conduct to that of segregationists during Jim Crow is about the moral equivalency of the blatant civil rights violations of blacks during that era and the blatant violation of my civil rights by Judge Whyte.
As noted in a prior post, Judge Whyte granted the City of San Jose a motion for summary judgment in my lawsuit that was a total fabrication, pure fiction, a complete hoax. He also allowed the City to conspire with my attorney to dismiss a defendant in that lawsuit without my knowledge or permission. That defendant, Tuck Younis, was the most important defendant in my case because he violated my rights knowingly. Younis also committed perjury in a deposition and in a declaration to the court. The law is perfectly clear that only I, the plaintiff, had the right to dismiss Younis from my lawsuit. My attorney, Stuart Kirchick, committed a serious ethical violation by agreeing to the dismissal of Younis from my lawsuit without my consent and without a settlement agreement. There is evidence that Kirchick was bribed by City officials and that the court approved of his misconduct as well.
Younis was also in contempt of court because he refused to appear twice after being subpoenaed in a prior small claims action I filed against the City. It just so happens that the judgment in that small claims action from the state of California is critical to the judgment of Judge Whyte in my federal lawsuit. There was no litigation in the small claims action because the Commissioner made a ruling implying that the small claims court lacked authority to grant the compensation I was seeking without allowing any testimony from me or the City. Judge Whyte dismissed my federal lawsuit against the City based on the collateral estoppel effect of the small claims judgment despite the fact that there was no litigation and no record of what occurred in small claims court. The law is well settled that collateral estoppel, aka issue preclusion, does not apply to judgments rendered in California's small claims courts. When determining the preclusive effect of state court judgments, the full faith and credit act, 28 USC Section 1738 requires federal courts to follow the preclusion law of the state where the judgment was rendered. Judge Whyte failed to do so. Therefore, his judgment dismissing my lawsuit on the basis of collateral estoppel is unconstitutional and is void by law.
Furthermore, the intransigence of Judge Whyte has shown in refusing to change his clearly erroneous and discriminatory judgment in my case mirrors the intransigence of white government officials in the South during Jim Crow in refusing to abandon their discriminatory policies against blacks. I have filed three motions with Judge Whyte seeking relief from his discriminatory judgment in my case, all to no avail. Judge Whyte and District Court officials went as far as staging a phony hearing on one of my motions after I was told there would be no hearing. Court officials falsified docket entries falsely stating that my motion pertained to "Costs Taxed" when it actually pertained to fraud on the court by the City's attorney and Judge Whyte's violation of the full faith and credit act. During the hearing, the City was granted a secret or ex parte motion to dismiss because I followed the court's instructions and did not appear for the hearing. The clear intent of Judge Whyte and court officials were to obstruct justice, a felony offense.
As far as I am concerned, Judge Whyte is a disgrace to the bench. It is reasonable to conclude that he was paid off by the City of San Jose. All of his prior cases should be examined because of his corruption. It is laughable that he won an award in 2009 for unquestioned integrity and commitment to the rule of law. Judge Whyte is taking inactive status (retiring) on November 1st of this year. The timing of his retirement is somewhat suspicious considering the scandals linked to him. As a result of his retirement, many of Judge Whyte's colleagues are falling all over themselves saying nice things about him on the US District Court website.
Here are some of the things being said about Judge Whyte. Judge Whyte is a great judge and a great man. Those who appeared before him saw how smart and fair and wise he is. He is intensely devoted to doing justice. Really?! He treated everyone with respect and dignity. One colleague of Judge Whyte stated that he possesses a model judicial temperament - an endearing blend of modesty, patience, intellect, and even-handedness. Another of his colleagues stated that for over two decades Judge Whyte has exemplified many of the best qualities of the judges of the Northern District: diligence, fairness, humility, modeling and inspiring the treatment of everyone involved in the justice system with courtesy and respect, and above all practicality. The common sentiment throughout these comments seems to be that Judge Whyte is fair or even-handed and that he is fair and just. This is comical because Judge Whyte refused to follow laws in my case that were mandatory; and he ruled in favor of the City, even though, all of the facts and evidence favored me. This claim by me is corroborated by the record in my case. It's the absolute truth. The complimentary comments about Judge Whyte by his colleagues are total baloney. They are nothing more than propaganda in order to make Judge Whyte look good. However, nothing is going to make Judge Whyte look good because of his egregious conduct in my case, and apparently several other cases. Judge Whyte may have made several important decisions relating to intellectual property litigation, but his best and most important decision has been to retire because he no longer has any integrity or honor.
