Senator Graham's Investigation of the Bidens Lacks Credibility

I BASH REPUBLICANS JUST LIKE I BASH DEMOCRATS

If you have read my recent posts, then you know that I have hammered the Democrats for their hypocrisy and dishonesty regarding their efforts to impeach Donald Trump while ignoring a more egregious abuse of power scandal involving San Jose city officials and officials with the US District Court and the Ninth Circuit Court of Appeals.  I make no apologies for coming down hard on the Democrats. They deserve all my criticisms. I promise you there is a lot more to come. Don't take my criticism of Democrats to mean I am enamored with Republicans. It's just that the Democrats have been acting if they have lost their minds. Then comes along Senator Graham with this purely politically driven investigation into former VP Joe Biden and his son Hunter Biden. Hunter Biden got paid thousands of dollars a month as a consultant for Burisma Holdings, an energy company in the Ukraine, even though he had no experience in the energy industry. The conventional wisdom is that he got the position because his dad was the VP and the head of America's Ukranian policy. While there may not have been any wrongdoing, it surely looks like a conflict of interest which is bad when you are talking politics. However, the investigation into the Bidens will accomplish nothing because of its partisan nature. 

Like me, I hope that the rest of America is tired of the never ending politically motivated investigations by both political parties that have little credibility because they are initiated under the false pretense that politicians care so much about eliminating corruption and being loyal to the oaths they took to protect and uphold the Constitution. Graham's investigation into the Bidens is clearly a response to the Democrats impeachment inquiry into President Trump. Graham's justification for the investigation of the Bidens because of Hunter Biden's past position on the board of Burisma Holdings is that it "doesn't pass the smell test."

What doesn't pass the smell test is the ethics of Senator Graham. Senator Graham, who is Chairman of the Senate Judiciary Committee, failed to initiate an investigation into several felonies committed by San Jose city officials, officials with the US District Court and the Ninth Circuit Court of Appeals during the litigation of two lawsuits I filed against the City of San Jose for racial and disability discrimination. I am black/African American. This is the same allegation that I have leveled against Speaker of the House Nancy Pelosi, House Judiciary Committee Chairman Jerrold Nadler, and House Intelligence Committee Chairman Adam Schiff. When will both political parties stop claiming ethical superiority by opening investigations into their political rivals when it's clear both parties are equally corrupt. Senator Graham's ethical problems are detailed in the letters below:

Re: Ethics Violations by Members of the Senate Judiciary Committee/Petition for Redress of Grievance

Dear Members of the Senate Select Committee on Ethics:

            The purpose of this letter is to bring to your attention ethics violations by the following members of the Senate Judiciary Committee: Senator Lindsey Graham, Senator Chuck Grassley, Senator Dianne Feinstein, and Senator Kamala Harris. I am also asking that the Select Committee on Ethics open an investigation into my allegation. My allegation that the just named Senators violated Senate Ethics Rules are based on their failure to take action on complaint letters I submitted to each detailing criminal misconduct by San Jose city officials, officials with the U.S. District Court for the Northern District of California – San Jose Division and the Ninth Circuit Court of Appeals during litigation of two lawsuits I filed against the City of San Jose for racial and disability discrimination. I am black/African American. Furthermore, the rulings of the courts in each of my lawsuits are biased in favor of the City of San Jose and they are wholly inconsistent with the indisputable facts and well established law.
            On the website of the Senate Select Committee on Ethics under Constituent Service, it states that the First Amendment of the U.S. Constitution “guarantees the right of the people…to petition the government for a redress of grievances.” It also states that responding to inquiries of petitioners and assisting them before executive or independent government officials and agencies is an appropriate exercise of the representational function of each Member of Congress, as well as an important function of congressional oversight. The definition of redress by Merriam-Webster is to set right or remedy an unjust or unfair situation.
            Not only has there been no action taken on my complaint letters to Senators Graham, Feinstein, Grassley, and Harris, I have only received a response from Senator Feinstein acknowledging receipt of my letter. This is inconsistent with the obligation of elected officials to respond to inquiries of petitioners as noted above. What makes this matter so egregious is that the accused Senators are making a conscious decision to conceal from the public the criminal misconduct of San Jose city officials and officials with the U.S. District Court and the Ninth Circuit Court of Appeals that was perpetrated in order to cover up racism, bigotry and corruption.
            Also on the website for the Senate Select Committee it states that the general advice of the Ethics Committee concerning pending court actions is that Senate offices should refrain from intervening in such legal actions in most cases until the matter has reached a resolution in the

courts. In other words, the judicial system should be allowed to function without interference from outside sources. It is important to note that there are no pending actions in court relative to my two lawsuits because the courts have entered their final judgments. Nothing precludes Congress or the Senate Judiciary Committee from conducting investigations into my allegations against the courts based on Congress’ constitutional authority/obligation to provide oversight. It is important to keep in mind that my allegations against the courts and the City of San Jose involve very serious criminal misconduct. The criminal misconduct I am alleging includes bribery, conspiracy to obstruct justice and obstruction of justice, subornation of perjury and perjury, fraud, and witness tampering. These criminal acts involve creating a false document relative to a fraudulent stipulation of dismissal, falsifying court records, staging a phony hearing on a motion I filed and creating a fraudulent transcript and civil minutes for that hearing that contradict each other.
            In order to support my allegations of criminal misconduct by San Jose city officials and the courts are two attachments in pdf format on a flash drive that’s included in this packet. One attachment contain copies of a letter and documents sent to Inspector General Michael Horowitz alleging that former Attorney General Jeff Sessions and F.B.I. Director Christopher Wray, along with several other officials in the Department of Justice and F.B.I. are engaged in a cover-up of the criminal misconduct of San Jose city officials and federal court officials. The other attachment contains copies of a letter and documents I sent to Chief Judge Sidney R. Thomas of the Ninth Circuit Court of Appeals that is undeniable proof that the judgments in my two lawsuits against the City of San Jose are based on fraud; and that they are in violation of the Constitution and well established precedent and statutory law. The judgments are by law null and void. Yet, the courts refuse to vacate them. Also on the flash drive are copies of the complaint letters I sent to Senators Graham, Feinstein, Grassley, and Harris; along with copies of complaint letters I sent to Speaker of the House Nancy Pelosi, House Judiciary Committee Chairman Jerrold Nadler, House Intelligence Committee Chairman Adam Schiff, and Attorney General William Barr.
            The conduct of San Jose city officials and federal court officials is an egregious abuse of power that violates the public trust. What makes their conduct truly appalling is that their intent is to cover up racism and bigotry. The evidence of racism by San Jose city officials is indisputable because they state in court papers that the City’s anti-discrimination policies did not protect me, a black person, and that they had no duty to investigate my racial discrimination complaints against City officials. Even though San Jose city policy specifically states that discrimination complaints will be investigated, the courts ruled in favor of the City. It is worthy to note that state law and precedent also establish that City officials had a duty to investigate my discrimination complaints, and that they can be held liable individually under Section 1983 based on their deliberate indifference. Further evidence of bias by the courts and indifference to the City’s racist conduct is that the court in one proceeding exhibited hostility toward my discrimination lawsuit by asking why I was making this a federal case and why I didn’t just drop the darn thing (my lawsuit). Bias is also indicated by the fact that the courts ruled in favor of the City in my first lawsuit despite City officials’ admission that they had violated City policy and a state law that implicates a constitutionally protected interest. This flagrant bias against me by the courts also makes the judgments in my lawsuits null and void.  I want to make it clear that I am alleging that Senator Graham, Senator Grassley, Senator Feinstein, and Senator Harris are

intentionally covering up this matter. It is sufficiently clear that these Senators are in violation of the Ethic Rules of the Senate, as well as, the oath they took to protect and uphold the Constitution. A credible criminal case for collusion and obstruction of justice can also be made against these Senators because the intentional cover-up of a crime is in itself a crime. An investigation into this matter is warranted in order to protect the integrity of our judicial system and to set right this unjust situation. Please inform me of what action the Senate Select Committee will take in regards to my allegation.

Re: Complaint made with the Inspector General against the Department of Justice and the F.B.I.

Dear Chairman Graham:

            In a letter dated September 1, 2017, I informed you of a complaint I made with the F.B.I. and the Department of Justice against several San Jose city officials and officials with the U.S. District Court and Ninth Circuit Court of Appeals for public corruption based on crimes they committed during the litigation of two lawsuits I filed against the City of San Jose for racial and disability discrimination. I am black/African American. I received no response from you in regards to my letter. Please be aware that I also informed several other Members of Congress about my public corruption complaints as well. So far, there has not been an investigation initiated into my complaints by the F.B.I., the Department of Justice or Congress.
            The purpose of this letter is to inform you and the Senate Judiciary Committee of my complaint with Inspector General Michael Horowitz that several officials with the F.B.I. and the Department of Justice are engaged in a cover-up of the crimes committed by San Jose city officials and the federal court officials mentioned above. With this letter is a copy of the September 2017 letter I sent to you, as well as, copies of letters I sent to former Senate Judiciary Committee Chairman Chuck Grassley, Attorney General William Barr, Speaker of the House Nancy Pelosi, and House Judiciary Committee Chairman Jerrold Nadler.
            Also enclosed is a flash drive containing letters and documents I sent to Inspector General Horowitz and Chief Judge Sidney R. Thomas of the Ninth Circuit Court of Appeals. The letter and documents sent to the Inspector General detail the criminal acts of San Jose city officials and the federal court officials. The letter and documents sent to Chief Judge Thomas establishes that the judgments by the courts in my discrimination lawsuits against the City of San Jose are fraudulent and are void under the law. Yet, the courts refuse to vacate them as is required by law.
            I respectfully request that you present this matter before the entire Senate Judiciary Committee for investigation and action based on the compelling evidence of criminal misconduct by San Jose city officials and officials with the U.S. District Court and Ninth Circuit Court of Appeals, as well as, the cover-up of the crimes of these officials by the F.B.I. and the Department of Justice. Please advise me of the action that will be taken regarding my complaints.

Democrats' Rhetoric Dishonors MLK's Legacy

Many Democrats could not resist the temptation to attack the character of President Trump on MLK day. In a speech to the National Action Network in New York, Representative Hakeem Jeffries referred to Trump as the Grand Wizard of 1600 Pennsylvania Ave. Jeffries made other inflammatory remarks as well. He stated that "Jim Crow" may be dead, but he has nieces and nephews that are alive and well. Jeffries made another statement that only partially represents what Dr. King taught us. He said that when faced with racial hatred, Dr. King taught us to deal directly with the problem. You don't run from it. Congressman Jeffries is right that Dr. King taught us to deal directly with discrimination resulting from racial hatred. Dr. King also taught us to love and forgive those that oppressed us and deprived us of our rights because of their racist views. Dr. King's teachings emphasized unity and not the inflammatory and divisive rhetoric of Congressman Jeffries.
Also attacking the President on MLK day was Senator Bernie Sanders. I know he identifies himself as an Independent, but when it comes down to it, he is a Democrat. Senator Sanders called the President a racist at an MLK day event in South Carolina.
One of the more surprising MLK day speeches in my opinion came from former VP Joe Biden. It also occurred at the event hosted by National Action Network. Biden stated that whites have failed to acknowledge that systematic racism still exists in America. He gave the example of two men with the same qualifications looking for a job, one named Jamal and one named Jim. If Jim gets the job then whites have to admit that there is systematic racism. This statement by Biden should be condemned because it over simplifies the problem of racial inequality. It should also be condemned because it is racial stereotyping. It assumes that men named Jamal are either black, or they are another minority. Whereas, all men named Jim are white. I am sure that Democrats and the media would have a field day if this type of racial stereotyping came from President Trump or a Republican.
VP Biden also attacked President Trump for his response to the incident in Charlottesville and suggested that the hate being spewed by the KKK, neo-Nazis and white supremacists is facilitated by the actions of the President. Biden accused Trump of making a moral equivalence between the the violence of the white supremacists and the actions of the counter protestors. Biden also took exception to Trump for blaming both sides for the violence that occurred, and for saying that there were good people on both sides.
The former VP is as partisan as one can be. His words were motivated by politics meant to further the Democrats' agenda. It is unfortunate that he decided to turn what should have been a day to celebrate the great accomplishments of Dr. King into a day of Trump bashing based on his visceral hatred for the President. Biden, Jeffries and other Democrats are quick to say that Trump is the driving force behind the hatred of white supremacist groups while not acknowledging their own hatred for the commander-in-chief. Being that this was MLK day, let's take a look at what Dr. King had to say about how we should deal with hate groups such as the KKK, neo-Nazis and white supremacists. Dr. King said that hate cannot drive out hate; only love can do that. This suggests that there is a moral equivalence between the the opposing groups at Charlottesville because it is clear from the violence coming from both sides that both groups hated each other. Dr. King said let no man pull you so low as to hate him. Dr. King said "There is some good in the worst of us and some evil in the best of us. When we discover this, we are less prone to hate our enemies." This gives credence to Trump's assertion that there were good people on both sides in Charlottesville. Dr. King also preached that we should love our enemies because love has redemptive power that transforms individuals. Dr. King said "We must live together as brothers or perish together as fools. This is great advice from a great man that we should heed no matter what side of the political spectrum we are on.

Oversight Is Good Even If Politically Motivated

The responses from many of the Republicans and Democrats in regards to that memo by the Republicans alleging FISA abuses by the FBI for their use of that stupid "Steele Dossier" were over the top. Some of the Republicans were saying that this scandal is worse than Watergate. Others likened the actions of the FBI to the KGB. The Democrats, on the other hand, initially complained that the memo was a threat to our national security and that it was damaging to the morale of the rank and file of the FBI that work so hard to keep us safe. Former VP Joe Biden chimed in on this scandal by blaming Trump for the memo. Mr. Biden had some harsh words for the President, calling him a "joke," stated that his attacks on the FBI are a disaster, and that they are a "full throated and unvarnished attack on the FBI." The former VP is by no means the only high profile current or former government official coming to the defense of the FBI. However, the responses by both sides were hyperbole in overdrive and politically motivated.

My response to the Republicans and Democrats' responses is my default position when it comes to politicians. They are nothing more than hypocrites, and they care nothing about you and me. Really folks! This is just a game of politics to them. No matters what happens, they will all be fine. When it comes to government misconduct, it is the common folks like you and me that always get hurt and ignored. Many of the same Republicans claiming to be so concerned about corruption in the FBI and DOJ have totally ignored my public corruption complaints against San Jose city officials and the federal courts. Many of the same Democrats that are so quick to defend the integrity of the FBI and DOJ are well aware of the FBI and DOJ's refusal to open an investigation into my public corruption complaints against the federal courts and San Jose city officials. See my most recent posts that expose these phonies.

Even though I believe the Republicans are motivated by politics, I have to side with them on this one because potential abuse of the FISA process is a legitimate concern of many Americans. I also believe that corruption at the top levels of the FBI and DOJ is also a possibility and an investigation or oversight of these institutions is needed. See my post on December 6, 2017 that supports my belief. However, the Republicans call for oversight of the FBI and DOJ in regards to potential FISA abuses do not go far enough. The oversight of the DOJ and FBI should also extend to the FISA court itself. No institution of the government should be exempt from oversight when it possess such immense power to spy on us and deprive us of our constitutional right to privacy. Power corrupts and absolute power corrupts absolutely (Lord Acton). It's all about ACCOUNTABILITY! Something that is sorely lacking in government today. A prime example of this lack of accountability is the criminal misconduct mentioned above by San Jose city officials, officials with the US District Court and the Ninth Circuit Court of Appeals relative to the litigation of two lawsuits I filed against the City that is the subject of this blog. Accountability through oversight is a hallmark of our constitutional democracy. No one should dare question that fact. When you accept a job with the FBI, the DOJ and the federal courts, not only do you take an oath to protect and uphold the Constitution, you implicitly agree to have your conduct scrutinized by oversight in accordance with the checks and balances provision of the separation of powers doctrine. No democracy will thrive without some form of oversight of its institutions of government, particularly those officials that are unelected without direct accountability to the people they serve. This is in stark contrast with elected officials who are held accountable through the electoral process.

It was quite shocking and disappointing to see the Democrats and certain cable news channels oppose the release of the Republican memo. This apparent opposition to transparency, while shocking, is not what it seem. This is all about hatred for Donald Trump and a double standard. Any information that makes Trump look bad, they are for its release. Any information that might benefit Trump they oppose its release. We should look beyond the agendas of politicians and the media and recognize the importance of government oversight when it is reasonably warranted. In the instant case, it is clear that oversight is needed. It is a totalitarian state that function without government oversight, not a democracy like our own.

A Missed Opportunity - Donald Trump's Attack On Judge Curiel

I think it is safe to say that most people in this country have heard about Donald Trump's recent media meltdown attacking Judge Gonzalo Curiel. Judge Curiel is a US District Court Judge presiding over a lawsuit involving, the now defunct, Trump University. As we all know, Mr. Trump said that Judge Curiel made rulings that were biased against him because of Judge Curiel's "Mexican" heritage. Mr. Trump did not provide a single piece of evidence to support his allegation. Rightfully so, there has been a great deal of criticism of Mr. Trump for his clearly racist statements. The purpose of this post is not to pile on with more criticism of Mr. Trump. The purpose of this post is to focus on the issue that has been lost in all of this madness, the very real issue of bias by federal judges in this country, particularly the Ninth Circuit Court of Appeals and district courts within the circuit. It just so happens that Judge Curiel is assigned to a district court within the Ninth Circuit. I do not know anything about Judge Curiel or the lawsuit involving Trump University. It is also not my intent to imply that Judge Curiel is biased or corrupt. I only want to emphasize what has been the focus of this blog. Nearly all of my posts in this blog, which began in July 2015, have been devoted to corruption and bias in the Ninth Circuit Court of Appeals and the US District Court - San Jose Division relative to a lawsuit I filed against the City of San Jose. What pisses me off greatly is all of the high profile politicians that were so quick to come to the defense of Judge Curiel after Mr. Trump made his unfortunate comments. Yet, they have done absolutely nothing in defense of average citizens who have been the victim of bias and corruption at the hands of the lower federal courts. The list of those criticizing Mr. Trump include, VP Joe Biden and Senator Elizabeth Warren from the Democrat side; Speaker of the House Paul Ryan and former Speaker of the House Newt Gingrich on the Republican side, just to name a few. However, the list is much longer than these four. I only mention them because they were the first to come to mind. But my point is that politicians, as well as pundits, that stood up in defense of Judge Curiel missed a great opportunity to address a real problem with our federal courts. This was not an oversight. This was intentional and political. It is no secret that there is corruption and cheating in the Ninth Circuit Court of Appeals and the US District Court in San Jose. Just as I stated in my prior posts, the courts in my case committed flagrant violations of the Constitution and several federal statutes. Politicians have turned a wilful blind eye to this issue rather than address it head-on and risk a total collapse of our judicial system. Americans ought to know that the politicians who were so quick to criticize Donald Trump have no courage to stand up for their basic rights or protect and uphold the Constitution as they sweared to do under oath. When it comes to complaints against judges, politicians run and hide behind the separation of powers doctrine and the need for an independent judiciary. While an independnet judiciary is necessary for government to function properly, it does not mean that judges have the right to base their rulings on their subjective feelings and not on the rule of law, just as many seem to be doing. Complaints I made to the FBI, the US Attorney's Office, the House Judiciary Committee, the California Attorney General's Office, the Santa Clara County District Attorney's Office and the Santa Clara County Civil Grand Jury relative to criminal misconduct by federal court officials and San Jose city officials during the litigation of my lawsuit have not resuled in an investigation, not even an interview, even though the evidence of misconduct is indisputable and overwhelming.
